Terms of Service

1. Scope

These Terms of Service (hereinafter "Terms") govern the use of the mobile application and web platform "Seirazen" (hereinafter "App" or "Service"), operated by:

By registering for, accessing, or using the App, you agree to these Terms. If you do not agree to these Terms, please do not use the App.

2. Description of Services

Seirazen is a meditation app that provides personalized meditation content. The Service includes:

  • Free Meditations: Access to a selection of pre-produced meditations at no additional cost.
  • Premium Meditations: Extended meditation content that can be unlocked using credits.
  • Personal Meditations: Individually created meditations based on your input (topic, voice, background sound), generated using speech synthesis technology.
  • Alexa Integration: Optional playback of meditations via Amazon Alexa-enabled devices.

3. Registration and User Account

Registration is required to use certain features. You may register via email/password or through third-party authentication (Google, Apple). You are obligated to keep your login credentials confidential and are responsible for all activities under your account. Sharing your account with third parties is not permitted.

You may delete your account at any time through the App's settings. Upon deletion, all personal data and created content will be irrevocably removed.

You must be at least 16 years of age to register for and use the App. Persons under the age of 16 may only use the App with the consent of a legal guardian. If KaProblem e.U. becomes aware that a user under 16 is using the Service without appropriate consent, the account will be deleted immediately.

4. Credits and Digital Content

4.1 Credit System

Seirazen uses a credit system for acquiring premium content. Credits can be purchased through the App (in-app purchases via the Apple App Store, Google Play Store, or via the web platform through Stripe). There are two types of credits:

  • General Credits: For unlocking premium meditations.
  • Personal Meditation Credits: For creating individual meditations.

4.2 Nature of Digital Content

Credits and the meditations unlocked or created with them constitute digital content within the meaning of EU Directive 2011/83/EU (Consumer Rights Directive), which is not supplied on a tangible medium.

4.3 Explicit Consent and Right of Withdrawal

Important Notice Regarding Right of Withdrawal:

Pursuant to Article 16(m) of EU Directive 2011/83/EU (implemented in Austrian law as § 18 Abs. 1 Z 11 FAGG), the right of withdrawal does not apply to digital content not supplied on a tangible medium where the performance has begun with the consumer's prior express consent and acknowledgment that the right of withdrawal is thereby lost.

By purchasing credits and confirming the purchase, you expressly consent to the immediate provision of the digital content. You acknowledge that you thereby lose your right of withdrawal. Credits already purchased and meditations already unlocked or generated cannot be returned or refunded.

4.4 Prices and Payment

All prices are stated in Euros and include the applicable statutory value-added tax. Payment processing is handled by the respective platform (Apple App Store, Google Play Store) or by the payment service provider Stripe for web purchases. KaProblem e.U. does not have access to your complete payment data.

5. Usage Rights and Intellectual Property

Upon purchase, you receive a simple, non-transferable, non-sublicensable right to use the unlocked content for personal, non-commercial use. All rights to the App, meditation texts, audio files, designs, and other content remain with KaProblem e.U. or the respective rights holders.

The reproduction, distribution, public broadcast, or other exploitation of the App's content requires prior written consent from KaProblem e.U.

6. Availability and Liability

KaProblem e.U. endeavors to provide the App without interruption but cannot guarantee 100% availability. Maintenance work, technical disruptions, or force majeure may lead to temporary limitations.

The liability of KaProblem e.U. for damages caused by intent or gross negligence, as well as for damages to life, body, or health, and under product liability law, is unlimited.

Liability for damages caused by slight negligence is excluded, unless the liability is based on a breach of essential contractual obligations (cardinal obligations). Essential contractual obligations are those whose fulfillment is necessary for the proper performance of the contract and on whose compliance the contractual partner regularly relies and may rely. In such cases, liability is limited to the typically foreseeable damage.

Meditation content does not constitute a substitute for professional medical, psychological, or therapeutic advice. KaProblem e.U. makes no warranty regarding the suitability of the content for specific health purposes.

7. Acceptable Use

You agree not to misuse the App, including but not limited to:

  • Using automated access or scraping mechanisms.
  • Uploading content that is unlawful, offensive, or otherwise inappropriate.
  • Circumventing or manipulating the App's security mechanisms.
  • Exploiting security vulnerabilities of the App.

In case of violations of these Terms, KaProblem e.U. is entitled to suspend or delete your account.

8. Invitation System

Seirazen may use an invitation system where existing users can generate invitation codes. Invitation codes are valid for a limited time and may not be sold or commercially distributed.

9. Amendments to These Terms

KaProblem e.U. reserves the right to amend these Terms. Amendments that are advantageous or neutral to you become effective upon publication of the amended Terms in the App.

All other amendments will be communicated to you at least two (2) months before the planned effective date via email or in-app notification. The amended Terms shall be deemed accepted if you do not object in text form (e.g., by email to [email protected]) within one (1) month of receipt of the notification. You will be specifically informed of your right to object and the consequences of non-exercise at the time of notification.

If you object to the amended Terms, you may delete your account at any time. KaProblem e.U. is also entitled to terminate the usage agreement with four (4) weeks' notice in such cases.

10. Governing Law and Jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers within the meaning of the Austrian Consumer Protection Act (KSchG), the mandatory provisions of the law of the country in which the consumer has their habitual residence shall apply. The place of jurisdiction for disputes with businesses is Kufstein, Austria. For consumers, the statutory places of jurisdiction apply.

11. Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/

Our email address can be found in the legal notice above. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

12. No Waiver

The waiver by KaProblem e.U. of any breach or non-performance shall not be construed as a waiver of rights arising from any prior or subsequent breach or non-performance.

13. Language

These Terms are available in German and English. The binding version is the language in which you completed the registration process. In case of doubt, the German version shall prevail.

14. Severability Clause

Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid provision that most closely reflects the economic purpose of the invalid provision.
